Terms of Use
The following Terms of Use on which you may or will be provided access to WorkingCaregiver.com and the Senior Services Providers listed in our Network. When and by accessing WorkingCaregiver.com you agree to be bound by these Terms of Use.
WorkingCaregiver.com (the "Site") is owned and operated by WorkingCaregiver, LLC; a Texas limited liability company. WorkingCaregiver, LLC may amend this Agreement at any time by posting amended terms and conditions on the Site.
1. The Site. The Site offers a senior referral service that strives to the best of it's ability to match and help coordinate requests from potential customers ("You" or "Users") with senior service providers who offer financial, medical, healthcare, home care, and other products or services ("Senior Service Providers") that may be able to meet Users' or Your needs. WorkingCaregiver is not involved in the actual transaction between Users and Senior Care Providers and we do not promote or recommend any particular Senior Care Provider. Therefore WorkingCaregiver, LLC cannot ensure that a transaction will occur or if it does occur that it will satisfy the needs of either Senior Service Providers or Users.
The Site acts as a directory or a place for Users to submit requests to Senior Service Providers who are clients of WorkingCaregiver, LLC, and the information you provide to us will be sent to Senior Service Providers within our network. The Site does not dispense medical or legal advice. Charges associated with this senior service referral system are incurred by the Senior Service Providers. All rights relating to the Site, including ownership as to content, materials, trademarks and other intellectual property contained in the Site, are the exclusive property of WorkingCaregiver, LLC and the Senior Service Provider(s) delivering "specific to their profession" content. You the User may not copy, reproduce, publish, disassemble, decompile, modify or make any other use of the Site or content contained therein other than as expressly provided hereunder or as may be expressly permitted by WorkingCaregiver, LLC in writing. The Site may contain links to other websites owned or operated by third parties. WorkingCaregiver, LLC has no responsibility, obligation or liability with respect to such third party sites. WorkingCaregiver, LLC makes no warranties with respect to such sites and You access them at your own risk.
2. You are responsible for maintaining the accuracy and sufficiency of information You supply to the site and agree to provide and maintain true, complete and correct information on the Site. You may not use the Site in violation of any applicable law. You have no right to transmit harmful, threatening, obscene or other objectionable material. You may not allow anyone else to use Your identification or access the Site using your identification. If You find out that someone is using your identification, you must immediately notify WorkingCaregiver, LLC immediately of any unauthorized use of your email or any other suspected breach of security as to the Site. You acknowledge that WorkingCaregiver.com screens information Users provide to the Site. You authorize WorkingCaregiver, LLC to provide information You submit to the Site to Senior Service Providers for the purpose of matching your request and elder care needs with the services of Senior Service Providers.
3. WorkingCaregiver, LLC is committed to your Privacy and will only use Your Information in accordance with our Privacy Policy and will notify Providers who use Your information and any other organizations to whom You authorize release of your information to use it in accordance with our Privacy Policy. We collect personal information voluntarily, including all information submitted by Users and non-identifiable information involuntarily. Some information that we collect is mandatory in order to receive referral services from us.
4. You shall release and indemnify and save harmless WorkingCaregiver, LLC and its officers, agents, employees and attorneys from all suits, actions, losses, damages, claims or liability of any character, type, or description, including, without limiting the generality of the foregoing, all expenses of litigation, court costs, and attorney’s fees arising out of or occasioned by, the acts or omissions of arising out of or in any way connected with any dispute You may have with any Senior Service Provider in the WorkingCaregiver, LLC network.
6. Disclaimer. You use the Site at your own risk. The site is offered an "as is" basis. Nor does WorkingCaregiver, LLC, it's employees, officers, directors, attorneys, contractors makes any warranty expressed or implied with respect to the senior services provided or content, products and disclaim any implied warranty of those merchantability. You acknowledge that the use of the Internet and the site involves inherent risks.
7. Limitation of Liability. In No or Any event shall WorkingCaregiver, LLC, its employees, officers, or directors, attorneys, contractors be liable for lost profits or any special, incidental, indirect, punitive, or consequential damages in connection or arising out of the Site or the inablility to use the site or the agreement..
8. This agreement constitutes the entire agreements between You and WorkingCaregiver, LLC. The rights and obligations of the parties under this Agreement shall be governed in all respects by the laws of Texas. This Agreement is not assignable, transferable or sublicensable by You without WorkingCaregiver, LLC's prior written consent. You do not have any authority of any kind to bind WorkingCaregiver, LLC in any respect whatsoever. All notices under this Agreement shall be in writing and shall be deemed to have been duly given when receipt is electronically confirmed, if transmitted by facsimile or email or upon receipt, if sent by certified or registered mail, return receipt requested.

10. You acknowledge and certify that WorkingCaregiver.com and WorkingCaregiver, LLC has made the following disclosures to You throughout this website: The manner in which WorkingCaregiver, LLC selects its group of Senior Service Providers to which it could make a referral; The fact that the Provider has paid or will pay a fee and membership fee to WorkingCaregiver; The manner in which WorkingCaregiver, LLC selects a particular Senior Service Provider for You from its Senior Service Provider Network; The nature of the relationship between the referral services and the network of senior service providers to whom WorkingCaregiver, LLC can make the referral; and The nature of any restrictions that could exclude such an individual or entity from continuing as a Senior Service Provider. |
